Conditions Générales de Vente

These General Terms of Sale define the conditions under which product sales will be made on GroveryX platforms.

In the GTS, the following terms and expressions will have the following meaning:

“Buyer” means any customer of GroveryX to whom the products are offered for sale or sold.

« Seller » means GroveryX, offering products for sale.

GroveryX reserves the right to modify the Terms and Conditions without notice.

ARTICLE 1: PRODUCTS

The description of the products on the website www.groveryx.com indicates the characteristics and the price of these for the needs of the customer.

ARTICLE 2: ORDER

Any order implies full and unreserved acceptance by the purchaser of these GTS. To place an order, the Buyer must have an identifier (valid phone number or email address) required to receive confirmation of his order. GroveryX submits to the customer a field to be filled in for the validation of the order and may be required to request supporting documents (if necessary). The customer accepts and recognizes that the validation by him of his order manifests the proof of his consent to the said order.

GroveryX carries out the checks necessary to take the order into account, in partnership with the company CinetPay. If necessary, additional information may be requested from the customer.

In the event of unavailability of the Product ordered, GroveryX, which cannot be held liable on this account, undertakes to notify the customer as soon as possible of new deadlines or, if applicable, offer him a refund.

ARTICLE 3: FINANCIAL CONDITIONS

The price of the products, expressed in XOF (West Africa Franc), all taxes included, and excluding delivery costs, are those in force at the time of validation of the order by the customer.

Depending on the Product ordered, the customer must pay the full price thereof according to the means of payment authorized on the site.

 The invoice is sent to the Buyer on a paperless medium. On simple request from the Buyer, the invoice can be sent to him on paper, instead of the paperless medium.

ARTICLE 4: DELIVERY

The products are delivered to the place designated by the customer. Deliveries are made by the delivery service of GroveryX according to its delivery methods. Without prejudice to the legal provisions relating to the guarantee of conformity and those relating to defects in the item sold, the customer is invited to check the products upon receipt and to make reservations if the products delivered do not comply with their order or if they are damaged. Reservations should be addressed directly to the GroveryX deliverer or to GroveryX Customer Service.

Delivery will take place on the day and time designated by the customer, possibly with a maximum additional margin of 30 minutes. The cost of delivery depends on the day and time of delivery chosen, the characteristics of the order and the delivery address.

ARTICLE 5: GUARANTEES

The Seller takes the greatest care in the execution of the order and the quality of the products. The products purchased from GroveryX benefit from a commercial guarantee in accordance with the indications mentioned on the platform. GroveryX undertakes to ensure compliance with this warranty from the date of delivery of the product.

GroveryX undertakes to provide the customer with identical products upon delivery, in accordance with his order made online.

The Seller ensures compliance with the provisions of Law No. 016-2017 / AN on the Organization of Competition in Burkina Faso. By refraining from any sale of expired or prohibited products, it intends to specifically comply with Articles 53 and 60 of this law relating respectively to warranty and after-sales service, and to consumer safety.

The Seller undertakes to guarantee the defects of the goods sold in accordance with Articles 1641 to 1649 of the Civil Code.

Any warranty is excluded for incidents arising from fortuitous events or force majeure as well as for replacements or repairs resulting from normal wear and tear of the product. Also, any deterioration or accident resulting from malicious acts, negligence, faulty installation, monitoring or maintenance and abnormal or non-compliant use of the product are excluded from warranty.

ARTICLE 6: COMPLAINTS

In the event of complaints made by the customer to GroveryX, amicable settlement will be preferred. They must be brought to the attention of the Seller as soon as possible for better support.

ARTICLE 7: RIGHT TO RETRACT

In the context of an order, the Buyer has seven (07) days from the delivery of the products to retract. To exercise the right to retract, the Buyer must notify his decision to retract, before the expiry of the aforementioned period, by means of an unambiguous declaration. The Buyer must return the products, in a condition suitable for remarketing, in their original packaging, accompanied by all their accessories, instructions and documentation, without undue delay. The return of products is the responsibility of the Buyer and at his own risk. The responsibility of the Buyer is only engaged with regard to the depreciation of the products resulting from handling other than those necessary to establish the nature, characteristics and proper functioning of the products. Any return that is incomplete or sent to an incorrect address cannot be processed. GroveryX will reimburse all sums paid by the Buyer for the order, without including delivery costs, no later than 30 days from the date on which it is informed of the withdrawal decision from the Buyer. The reimbursement will be conditioned on the actual receipt of the products by GroveryX.

ARTICLE 8: TRANSFER OF OWNERSHIP

GroveryX transfers ownership of the products sold to the customer upon full payment of the price. As for the risks, they will only be transferred to the customer upon delivery or handing over of the products.

ARTICLE 9: CONFIDENTIALITY

Any information made available to GroveryX by the customer in the context of an order will be used strictly in a professional manner. It cannot be used without the customer’s knowledge for any other purpose likely to be prejudicial to him.

ARTICLE 10: PERSONNAL DATA

The Buyer’s personal data are processed in accordance with the law n ° 001-2021 / AN on the protection of individuals with regard to the processing of personal data and according to the privacy policy of personal data of GroveryX .

The data communicated by the Buyer when placing his order is subject to automated processing which ensures their confidentiality.

Article 11: COMPETENCE

The GTS are governed by Burkinabè law. Any dispute with professional Buyers or traders, not settled amicably, will fall under the jurisdiction of the courts within the jurisdiction of the Ouagadougou Court of Appeal. For non-professional Buyers, the legal jurisdiction rules will apply.
